Terms of Use

By downloading, browsing, accessing or using the Buzz mobile application (“Mobile App”), you agree to be bound by these Terms and Conditions of Use herein. We, BEEBAG SDN BHD (“Buzz”) reserves the right to amend these terms and conditions at any time without prior notice. If you disagree with any of these Terms and Conditions of Use hereinbefore and hereinafter, you must immediately discontinue your access to the Mobile App and your use of the services offered on the Mobile App and upon cessation of the usage of the Mobile App the Users have no rights or claims against Buzz. Continued use of the Mobile App will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time without prior notice.

Definition

In these Terms and Conditions, unless the context otherwise requires, the following words and expressions shall have the following meanings: –

  • “Buzz” means BEEBAG SDN. BHD. (Company No. 1421416-D);
  • “Platform” refers to the website, mobile application, and rewarding platform owned and managed by Buzz;
  • “Member” or “Members” means individual(s) who has been accepted by Buzz as participating member(s) of the Platform in accordance to the Terms and Conditions set forth herein;
  • “Membership” means membership to the Platform in accordance to the Terms and Conditions herein;
  • “Merchant” or “Merchants” means the participating merchant(s) of the Platform;
  • “Mobile App” means the Buzz mobile application made available for downloading into the Member’s Android or iOS mobile phone;
  • “Rewards” means the products, services, rewards, gifts or other benefits made available by Buzz under a rewards program established by Buzz which may be redeemed by Members;
  • “Buzz Points” means the Points awarded to Members for activities completed at participating Merchants’ outlets;
  • “Website” means the website owned and operated by Buzz and located at www.getbuzz.co or at such other domain name registered by Buzz.

Membership

These Terms and Conditions (including the Policy on Privacy and Data Protection) govern the award and use of Buzz Points by Members, and set out the terms of the agreement between Buzz and each Member with regards to the Platform. A person intending to participate in the Platform can sign up and register for the Platform with Buzz by registering an account on the Platform and can then earn Buzz Points on various activities at participating Merchants’ outlets. By applying to register with the Platform, a Member is deemed to have accepted these Terms and Conditions. The Member is agreeable to provide the mandatory information required for the purpose of registering as the Member for the Platform. Buzz may, in its sole discretion decide and without the need to assign any reason, refuse an application made by any person to be a Member.

Buzz reserves the right to amend these Terms and Conditions at any time and from time to time as it deems fit at its absolute discretion and with or without prior notification to Members. Members may obtain the updated version of these Terms and Conditions from Buzz’s website www.getbuzz.co or the Mobile App. Notwithstanding the foregoing, continued use of the Website or Mobile App will be deemed to constitute your acceptance of the new Terms and Conditions. Failure to observe the Terms and Conditions stated herein by a Member may result in termination of Membership.

Buzz reserves the right to, at any time, vary or terminate the Platform or any privileges under the Platform or withdraw the NFC Tag from use with or without prior notification to Members and without being liable in any way to Members. Buzz may, at its sole discretion, remove any or all Members from the Platform at any time.

Unless stated otherwise in writing by Buzz and/or Co-brand Merchants, Membership is open to individuals who are 12 years of age and above. Residents and non-residents of Malaysia may apply for membership.

Buzz Points Award & Redemption

Buzz Points will be awarded at a rate agreed between Buzz and any partnering brands or merchants when a Member completes specific activities as required to collect Buzz Points. Buzz may alter the method and rate at which Buzz Points are awarded at its discretion from time to time. Buzz Points may be redeemed at any participating Merchant’s outlets, listed stores through the Mobile App or by any other methods as Buzz may determine from time to time. Once redemption has been accepted by Buzz, it cannot be cancelled, exchanged or returned. Buzz Points cannot be exchanged for cash and can only be used for redemption of Rewards. Rewards may be redeemed by a Member using Buzz Points or a combination of Buzz Points plus cash/card/vouchers. On confirmation of redemption, Buzz Points used for redemption will be deducted from the Member’s account. Buzz Points expire 36 months from the issuance date on a first in first out basis.

All goods and services are subject to availability and further subject to all applicable legal rules and the terms and conditions (including booking requirements, cancellation restrictions, return conditions, warranties and limitations of liability) as imposed by the supplier of the Reward and Buzz. Buzz makes no representation or warranty of any kind (whether express or implied) with regards to the condition, fitness for purposes, merchantable quality or otherwise of any Rewards redeemed. When Buzz Points are used to redeem for a Reward that is to be supplied by a third party, Buzz may (but is not obliged to) act as an intermediary between the Member and the third party. Buzz will use its best endeavours to ensure such Rewards are supplied by the third party. Buzz shall not however be responsible for any failure or delay by a third party to supply such Reward, or loss or damage to such Reward during delivery.

Buzz Points cannot be used for redemption until they are credited into the Member’s account. Buzz Points will be recorded in the Member’s account only after the Merchant has notified Buzz of the details of the relevant action which Buzz Points are issued. The Buzz Points will be recorded in the Member’s account depending on the frequency of notification from the respective participating Merchants.

General Provision

Buzz may, at its discretion, replace or substitute any advertised Reward with a similar Reward. A Member may check his/her Buzz Points online at the Mobile App.

In the event of a failure or breakdown of any equipment or system used in connection with the Platform, Buzz may refuse request for redemption or to award Buzz Points on any transaction. Buzz and the Merchants shall not be responsible or liable in any manner in the event Buzz Points are not awarded or redemption cannot be made or a Member is unable to check his Buzz Points, due to any failure in the equipment or system used in connection with the Platform.

The use of the Website and Mobile App is at the Members’ own risk. Members are responsible for the security of their user login ID and password. Buzz accepts no liability for the disclosure of the user login ID and password by the Member to a third party, whether intentionally or not. Buzz reserves the right to block a Member from accessing his account online if Buzz has reasonable grounds to suspect that fraud or misconduct has been committed by the Member or a third party.

While Buzz uses reasonable efforts to include up to date information in the Website or Mobile App and in all its publications, Buzz makes no warranties or representations as to their accuracy, reliability, completeness or otherwise. The contents, materials, products or other services available in Buzz’s publications or accessible through the Website or Mobile App are on “as is” and “as available” basis. Buzz disclaims all warranties (express or implied) including but not limited to, merchantability, fitness for purpose and non-infringement, in relation to the contents, materials, products or other services published in any of its publications or available on the Website and Mobile App. Buzz does not warrant that the Website and Mobile App will be error-free, free of viruses, bugs or other harmful components or access to the Website or Mobile App will be uninterrupted. Members are responsible to implement security measures in their computers or Mobile phone before accessing the Website or Mobile App. Buzz shall not be liable in any way for any direct, indirect, punitive, incidental, consequential or other damages howsoever arising out of (i) the use of, or access to, the Website or Mobile App; or (ii) delay or inability to use or access the Website or Mobile App; or (iii) for any content, information, material, products or services published in, posted on, advertised in or obtained through Buzz’s publications or the Website or Mobile App.

Notification of any matter in relation to the Platform shall be deemed given to Members if it is made via any one of the methods below:

  • by posting on the Website; or
  • by sending an email to Members who have provided email address to Buzz; or
  • by publication in a newspaper; or
  • sending by ordinary post to the last known address of Members appearing in Buzz’s records.

If Buzz sells or transfers the Platform to another party, Buzz may transfer all of Buzz’s rights and obligations under these Terms and Conditions without any consent from any Member. Buzz may further disclose and transfer all and any information and data which Buzz holds or which resides in the system of Buzz in relation to the Members and all transactions made by Members, including purchase and redemption transactions (“Information”) to the new transferee, or disclose any such Information to a prospective new buyer. The Member hereby unconditionally and irrevocably agrees to such transfer and disclosure of the Information to the new transferee or the prospective new buyer.

Buzz will only be liable to a Member (and not any other third party) who suffers loss in connection with the Platform arising from Buzz Points being wrongly deducted or non-credit of Buzz Points entitled by a Member and in such a case, Buzz’s sole liability will be limited to crediting to the relevant Member’s account such Buzz Points which have been wrongly deducted or should have been credited but were not. Buzz shall not be responsible where: (i) there is no breach of a legal duty of care owed to such Member by Buzz or by any of Buzz’s employees, staffs, authorized personnel or agents; or (ii) such loss or damage is not a reasonably foreseeable result of any such breach at the time Buzz enters into this agreement with such Member; or (iii) any increase in loss or damage resulting from breach by such Member of the Platform.

Buzz and the Merchants are not responsible or liable to the Members for indirect, consequential or economic losses, loss of profits, loss of opportunity or punitive damages of any kind.

Buzz may further establish rules, procedures and policies in relation to any matter regarding the Platform, all of which shall form part of the Terms and Conditions. These Terms and Conditions as set out herein shall prevail in the event of any conflict or inconsistency with any other documents, statements, rules, procedures, policies or communications, issued by Buzz, including FAQ, advertising or promotional materials.

Member confirms that he has read, understood and agreed to be bound by the Privacy Policy of Buzz (which is available at www.getbuzz.co), as may relate to the processing of his personal information. For the avoidance of doubt, Member agrees that the said Privacy Policy shall be deemed to be incorporated by reference into this Terms & Conditions.

These Terms and Conditions are governed by the laws of Malaysia and Members shall submit to the exclusive jurisdiction of the courts of Malaysia.

Some materials on the Website and other Buzz promotional materials are the intellectual property of participating Merchants, or other third parties. Members have no right to use such intellectual property.

Each exclusion or limitation of liability in these Terms and Conditions shall also apply for the benefit of each of the participating Merchants and their employees or agents.

General Provision

To be eligible to redeem or make any reward purchase from the platform, you must be twelve (12) years of age and above.

  • Once the reward is purchased, no cancellation will be allowed.
  • Upon purchase of reward, Members are entitled to redeem the reward from the relevant Partner in accordance with the terms and conditions stated on the reward.
  • Acknowledgement: You hereby acknowledge that the Partners are:
  • the seller or provider of the reward code; and
  • solely responsible for providing Member the products and/or services as described in the reward.
  • Reproduction, sale, resale or trade of an reward is prohibited. Any attempt to carry out any of these will render reward code to be voided at our discretion. If the reward is redeemed for amount lower or less than its face value, Members will not be entitled to any cashback, cash refund or new reward equivalent to the difference between the face value and the amount redeemed as each reward can only be redeemed once based on its entire value.
  • It is at the sole discretion of the Partner to determine whether the reward can be combined with any other promotion, voucher, third party certificate or coupon. Members are advised to read and fully understand each reward’s Terms & Conditions before purchasing or redeeming it.
  • Neither Buzz nor the Partner is responsible for any lost or stolen reward codes. It will be the sole responsibility of the Member to safeguard the reward code(s). Please ensure that you do not disclose your reward code(s) to anyone except for redemption purposes at the participating Partner’s outlets or e-stores.
  • Each reward is unique and can only be redeemed ONCE. Strictly non transferable, non-refundable nor exchangeable for cash, in part or full.
  • Reward purchased must be redeemed within the reward validity period. Buzz will NOT entertain any request to extend the validity period of the reward nor issue a new reward code as replacement.
  • Buzz will not accept any liability or bear any responsibility for the goods or services purchased with the reward and if any of our Partners varies the price for the same goods or services purchased with the reward. Any complaints about the goods or services purchased with the reward must be resolved by you directly with the Partner concerned.
  • Buzz and Participating Partners reserve the right to amend or change the offers/promotions and these Terms and Conditions at any time and from time to time as it deems fit at its absolute discretion without prior notification to Members.

Beebag Sdn. Bhd. follows all legal requirements to protect your privacy. Our Privacy Policy is a legal statement that explains how we may collect information from you, how we may share your information, and how you can limit our sharing of your information.

Our Pledge

Beebag Sdn. Bhd. is committed to safeguarding your privacy and ensuring that your personal data is protected. We therefore make sure that our policies and practices in relation to personal data comply with the requirements of the Personal Data Protection Act 2010 (the “Act”) under the laws of Malaysia. By providing us your personal data and your continued use of our services, you agree to be bound by the terms and conditions below and consent to the processing of your personal data in accordance with this Privacy Policy.

Introduction and Application

  1. This policy (“Privacy Policy”) describes how Beebag Sdn. Bhd. (Company No. 202101021116) (“Buzz”) manages Personal Data which is in our possession or under our control. “Platform” refers to the website and mobile applications operated by Buzz. “Personal Data”, is defined in the Personal Data Protection Act 2010 of Malaysia (“PDPA”), and currently refers to any information in respect of commercial transactions, that relates directly or indirectly to an individual, who is identified or identifiable from that information or from that and other information which is in our possession and includes any sensitive personal data and expression of opinion about the individual.
  2. By using our services pursuant to your agreement(s) with us (“Services”), operating any account maintained with us, accessing the online platform operated by us (which is accessible through our website at www.getbuzz.co or through our mobile application) (“Platform”), websites or mobile applications, or otherwise providing information to or communicating with us, you are taken to have agreed to our collection, use, processing and disclosure of your Personal Data in accordance with this Privacy Policy.
  3. This Privacy Policy does not supersede or replace any other consents you may have previously or separately provided to us in respect of your Personal Data, and your consent to this Privacy Policy is in addition to any other rights which we may have at law to collect, use, process or disclose your Personal Data to the extent that such previous or separate consent doesn’t lessen our rights.
  4. The words “we”, “us”, “our” or any of their derivatives refer to Buzz and its successors and any novatee, assignee, transferee or purchaser of Buzz’s rights and/or obligations hereunder and any reference to Buzz includes a reference to such successor, novatee, assignee, transferee or purchaser. The words “you”, “your”, “yours” or any of their derivatives refer to the person using our Services, operating any account maintained with us, accessing our Platform, website or mobile applications, or otherwise providing information to or communicating with us and shall include, as the context may require, personal representatives (as the case may be).
  5. This Privacy Policy shall be governed by, and construed in accordance with, the laws of Malaysia. Without prejudice to your rights under any applicable laws, any dispute arising out of or in connection with this Privacy Policy and/or the documents referred to herein, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by the Courts of Malaysia and both you and we hereby unconditionally and irrevocably submit to the exclusive jurisdiction of the Courts of Malaysia.

Personal Data That We Collect

  1. We collect, use, disclose, transfer and otherwise process Personal Data about you or individuals who are connected or associated with you including but not limited to your legal representatives (“Associated Persons”) in accordance with this Privacy Policy.
  2. The Personal Data that we collect or may collect include:personal details such as name, identity card number, age, gender, nationality, date of birth, address, telephone number, email address and other details you provide when you register an account on the Platform

    • Other information that are, have been or may be collected by us or Merchants, or which you provide to us or Merchants from time to time, in connection with any service, transaction, contest, survey, promotion, questionnaire or communication with us relating to the Platform or otherwiseersonal interests or preferences such as language, product or content interests, communicating and marketing preference.

    • Username, password and other identifiers when you register at our website

 

Certain information requested by us are mandatory which you must provide and agree to the processing of such mandatory information by us, failing which, we will not be able to approve or continue your account with the Platform or provide you information, updates, products or services you requested or relating to the Platform.

Sources of Information

The Personal Data has/or will be obtained from the following sources, where applicable, or such other sources which we may see fit from time to time:

  1. when you register an account on the Platform or register your interest with us to obtain information and updates on any products and services
  2. when you visit our website or social networking sites
  3. when you enter contests, activities or respond to surveys, promotions or questionnaires from our Merchants and the Platform
  4. when you make any transaction at any of Merchants’ outlet pursuant to any transaction or inquiry or communication made with or to us
  5. when you make any transaction on the Platform

Purpose of collecting and processing your personal data

We may use your Personal Data for our business purposes, including the provision and continuing operation of the Platform and the Services provided to you. This includes, the following purposes (“Purposes”):

  1. to communicate with you
  2. to process your application, inquiry or request
  3. to provide the products and services relating to the Platform or such other goods and services you requested
  4. for administration of Platform
  5. to respond to your queries
  6. to conduct surveys, research and statistical analysis
  7. to help us and partnered Merchants monitor and improve our services and also
  8. to comply with applicable laws, proceedings or inquiries from regulatory authorities, and enforcement agencies
  9. any other purposes permitted by applicable laws
  10. to market and promote other products and services that are or may be offered by us, our partners, Merchants or sponsors for direct marketing purposes
  11. to provide you with information and updates on the Platform or products and services requested

 

You may, at any time, withdraw your consent to receive marketing information from us. If you wish to do so, please click on the “Unsubscribe” option available on all marketing/newsletter emails that you may receive from us or contact our Data Protection Officer at support@getbuzz.co 

Disclosure and Sharing of Your Personal Data

To facilitate the Purposes and the provision of products and services to you, we may process, use and disclose your personal information to the following classes of third parties: –

  1. regulatory authorities and enforcement agencies
  2. any court of law or any relevant party in connection with any claim or legal proceedings
  3. our contractors, service providers, consultants, auditors and advisors on a need-to-know basis
  4. our Merchants, partners and sponsors
  5. any actual or potential assignee, transferee or acquirer of our company or business

Transfer of your personal data outside Malaysia

We may transfer, store and/or process your Personal Data outside Malaysia. In doing so, we will comply with the PDPA and other applicable data protection and privacy laws.

Retaining your personal Data

Your Personal Data is retained as long as the purpose for which it was collected remains and until it is no longer necessary for any other business purposes or to comply with any Applicable Laws.

Rights of Access and rectification

Supply of personal data

  1. Except as otherwise provided in this Privacy Policy, we only collect the Personal Data that you provide to us. If you would prefer that we do not collect Personal Data from you, please do not provide us with such information, use our Services, operate any account maintained with us, or access our Platform, websites or mobile applications. By using our Services, operating any account maintained with us, visiting our Platform, websites or mobile applications or otherwise, providing information to, or communicating with us you shall be deemed to have read and provided your consent to our collection, use, processing and disclosure of your Personal Data or Personal Data relating to other persons in the manner as described in this Privacy Policy. You may withdraw your consent to our collection, use, processing and disclosure of the Personal Data for any of the above Purposes, at any time by contacting us at support@getbuzz.co. If we do not receive any notification from you concerning our collection, use, processing and disclosure of the Personal Data, we shall proceed to continue to process the same for the Purposes as set out above, on the basis that you have consented to our current as well as all our previous collection, use, processing and disclosure of the Personal Data in accordance with this Privacy Policy.
  2. Please note that we may not be able to provide you with our Services if you do not provide us with your consent or withdraw your consent to the collection, use, processing and disclosure of the Personal Data for any of the Purposes.
  3. Where you provide us with the Personal Data of other individuals, we shall assume, without independent verification, that you have obtained such individual’s consent to our collection, use, processing and disclosure of their Personal Data in accordance with this Privacy Policy.

Use of cookies and related technologies

  1. Our Platform, websites and mobile applications (“apps” or an “app”) use cookies. A cookie is a small text file placed on your computer, system or mobile device when you visit a web site or use an app. Cookies collect information about users and their visit to the web site or use of the app, such as their Internet protocol (IP) address, how they arrived at the web site (for example, through a search engine or a link from another web site) and how they navigate within the web site or app. We use cookies and other technologies to facilitate your internet sessions and use of our apps, offer you products and/or services according to your preferred settings, track use of our web sites and apps and to compile statistics about activities carried out on our web sites and/or through our apps.
  2. A pixel tag, also known as a web beacon, is an invisible tag placed on certain pages of our web site but not on your computer. Pixel tags are usually used in conjunction with cookies and are used to monitor the behaviour of users visiting the web site.
  3. You may set up your web browser to block cookies which will in turn disable the pixel tags from monitoring your web site visit. You may also remove cookies stored from your computer or mobile device. However, if you do block cookies and pixel tags, you may not be able to use certain features and functions of our websites or the Platform.
  4. We also use analytics programs such as Google Analytics for web analytics purposes to manage and improve our websites, mobile applications, the Platform and/or our Services. Features of Google Analytics that we may use include Remarketing with Google Analytics, Google Display Network Impression Reporting, and Google Analytics Demographics and Interest Reporting. Accordingly, your information may be collected for reports such as impression reporting, demographic reporting, interest reporting and to assist with tailoring our online advertising to provide you with a better experience.   5. We and our third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together, to inform, analyse, optimise, and serve custom ads based on your interests, searches and prior usage patterns when visiting our websites, mobile applications and Platform, and for other market research analysis purposes such as impression reporting and how your interactions with these ads are related to visits to our websites, mobile applications and Platform, amongst others. As a consequence, third party vendors may show our ads on other websites or mobile applications. We neither support or endorse the goals, causes or statements of these websites or mobile applications which display our ads.
  6. Using the Google Ad Settings (https://www.google.com/settings/u/0/ads/authenticated), you may control the ads you view, block specific advertisers, learn how ads are selected for you, and opt-out of Google Analytics for Display Advertising. To opt out from any collection or use of information by Google Analytics, please download and install the Google Analytics Opt-Out Browser Add-on available at https://tools.google.com/dlpage/gaoptout. By opting out, you will not be subject to online advertising or marketing analysis by Google Analytics and you will no longer receive ads tailored to your browsing patterns and usage preferences.

Our web sites may contain links to other web sites which are not maintained by us. This Privacy Policy only applies to our websites, mobile applications, the Platform and/or our Services. When visiting these third party web sites, you should read their privacy policies which will apply to your use of the web sites.

Changes

Our Privacy Policy may change from time to time. We will post any privacy policy changes on this page, for which you will be notified. If you continue to use our Services, operate any account maintained with us, access our Platform, websites or mobile applications, and/or otherwise provide information to or communicate with us, you are deemed to have agreed to such changes without reservation.
